Welcome to Mopeso, a digital credit and mobile lending application owned and operated by MAGKONO FINANCING COMPANY INCORPORATED (Company Registration No. CS201910762, Financing Company License No. 1225).

These Terms of Service ("Terms") establish a legally binding agreement between you ("User") and the Company regarding your access to and utilization of the Mopeso mobile application ("App") and its associated financial solutions. By downloading, registering, or utilizing Mopeso, you acknowledge that you have thoroughly read, fully understood, and expressly consented to be bound by these Terms. If you do not accept these conditions, you must immediately cease all access to the App and its services.

1. Definition of Terms

  • Mopeso / The App: The digital platform and mobile lending application developed to provide short-term consumer financing and credit access to qualified individuals within the Philippines.
  • The Company / We / Us / Our: Refers to MAGKONO FINANCING COMPANY INCORPORATED, the legally registered and licensed financing entity that administers and operates Mopeso.
  • User / You / Borrower: Any individual person who downloads the software, registers an account, accesses the platform, or submits a loan application via Mopeso.

2. Scope and Availability of Services

Mopeso provides a comprehensive digital environment enabling Users to:

  • Establish, update, and manage a personalized secure digital account including identity verification.
  • Submit applications for short-term credit facility, subject to the Company's assessment, credit verification, and approval frameworks.
  • Receive disbursements of approved loan proceeds and track payment schedules digitally.
  • Access communication tools for repayment alerts, consumer assistance, and the resolution of inquiries or grievances.

3. Eligibility Criteria

To register an account and successfully utilize Mopeso, you must fulfill the following prerequisites:

  • Be a citizen or legal resident of the Republic of the Philippines, aged 18 years or older, with full legal capacity to execute binding contracts.
  • Possess and present valid, unexpired government-issued identification documents as requested.
  • Provide thoroughly accurate, current, and verifiable personal, professional, and financial records.
  • Demonstrate a stable and sufficient source of financial capability to fulfill all repayment commitments in a timely manner.

4. Obligations and Code of Conduct

As a condition of your utilization of the App, you explicitly agree to:

  • Supply exclusively genuine, accurate, complete, and updated data across all fields and submissions.
  • Strictly adhere to all prevailing local ordinances, statutes, regulations, and the conditions set forth in these Terms.
  • Settle all outstanding loan balances, interest, and applicable administrative fees on or before the designated maturity date.
  • Refrain from using the platform for any deceptive, unauthorized, speculative, or fraudulent schemes.
  • Non-compliance with these conduct standards may result in immediate account restriction, permanent deactivation, or the initiation of appropriate legal remedies by the Company.

5. Veracity and Maintenance of Information

The accuracy of the information linked to your profile remains your continuous responsibility. Submitting falsified, deceptive, or severely outdated data can lead to immediate loan application refusal, unilateral termination of your access, or statutory reporting to relevant regulatory databases under Philippine jurisprudence.

6. Loan Amortization and Repayment Policies

Borrowers are strictly obligated to repay their credit lines in accordance with the specific parameters detailed in their disclosure statement. A failure to settle debts punctually can lead to:

  • The immediate accrual of late payment penalties and additional administrative charges.
  • A negative adjustment to your credit score across national credit information systems.
  • The deployment of legal debt recovery procedures as authorized under the regulations of the Republic of the Philippines.
  • Conversely, punctual repayments enhance your credit footprint and maximize your eligibility for higher limits in the future.

7. Prohibited Uses of the Platform

The Mopeso interface must never be deployed for:

  • Identity theft, impersonation, or misrepresenting your affiliation with any third party.
  • Money laundering, terrorism financing, or any activity that violates anti-graft and corrupt practices acts.
  • Any activities detached from the transparent and legitimate borrowing services intended by the App.
  • Any identified suspicious behavior or unlawful operations will trigger immediate profile locking and comprehensive documentation forwarding to national law enforcement and regulatory bodies.

8. Protection of Account Credentials

You maintain exclusive responsibility for preserving the confidentiality of your login codes, passwords, and security PINs. You must not disclose these identifiers to any third party. You are required to notify us instantly if you detect any unauthorized access or breach of security. The Company disclaims all liability for financial losses or data compromises arising from a User's failure to safeguard their own account access details.

9. Core Financial Parameters

  • Credit Line Limits: Tailored individually depending on the analysis of your risk profile, credit history, and internal scoring metrics.
  • Tenor / Duration: Distinctly outlined and presented within the electronic loan contract prior to your formal acceptance.
  • Rates and Charges: All interest rates, service fees, and administrative adjustments are transparently broken down and disclosed on the confirmation screen before any fund disbursement.
  • Payment Gateways: Repayments are accepted exclusively through our list of authorized payment channels, including partner commercial banks, electronic wallets, and physical over-the-counter payment centers.

10. Data Privacy and Information Security

Mopeso handles your personal data with strict confidentiality, maintaining full alignment with the statutory mandates of the Philippine Data Privacy Act of 2012 (Republic Act No. 10173).

  • Purpose: Your information is gathered strictly for identity authentication, credit evaluation, fraud mitigation, service refinement, and statutory compliance.
  • Security Protocol: All data transmissions executed within the App are routed through highly secure, encrypted HTTPS channels (https://api.mopeso.com) and reinforced via industry-standard data encryption algorithms.
  • Third-Party Disclosure: The Company will never trade, lease, or distribute your private datasets to external entities for marketing or commercial gains without your explicit prior endorsement, except under valid judicial orders or regulatory mandates.

11. Proprietary and Intellectual Property Rights

All software code, visual assets, branding elements, text layouts, source materials, and trademarks embedded within Mopeso are the exclusive property of the Company. Users are strictly prohibited from copying, reverse-engineering, modifying, distributing, or repurposing any portion of the App without express written consent from the Company's authorized management.

12. Disclaimers and Limitations of Liability

While we strive to ensure uninterrupted, robust operational uptime for the App, Mopeso is provided on an "as-is" and "as-available" basis. The Company shall not be held liable for system downtimes, processing delays, or transactional failures caused by:

  • Events of force majeure, including natural disasters, public health crises, or severe civil disruptions.
  • Widespread internet service disruptions, external telecommunications failures, or grid outages beyond our reasonable control.
  • Sudden modifications in legislative frameworks, central bank policies, or SEC directives.

13. Service Suspensions and Termination

The Company reserves the right, at its sole discretion and without prior warning, to temporarily block or permanently delete your account if:

  • A material breach of any section of these Terms has occurred.
  • Our security protocols flag your profile for fraudulent, illicit, or irregular activity.
  • You default on your financial obligations or fail to complete mandatory identity validation processes.

14. Applicable Law and Venue for Disputes

These Terms shall be interpreted, construed, and governed according to the laws of the Republic of the Philippines. Any friction, claim, or controversy stemming from the use of Mopeso shall first be subjected to an amicable mediation process. In the event that a consensus cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the proper courts of Manila, Philippines, to the exclusion of all other alternative venues.

15. Policy Modifications and Revisions

The Company retains the right to modify, amend, or rewrite these Terms at any time. Any changes will be published directly within the App interface or communicated through our official channels. Your continued engagement with Mopeso following the publication of revised Terms implies your formal confirmation and acceptance of the updated framework.
